Terms of use for creators

1. Who we are and what these terms govern
- unblurz is a service of unblurz S.L. (registration details on the Contact page, unblurz.me/contact), a Spanish company ("unblurz" or "we").
- These terms govern the use of the unblurz app by the people who upload content for unblurz to sell ("creators" or "you").
- They are supplemented by the Content licence and royalties agreement, the Privacy policy and, when you get paid, by the Self-billing agreement or the Royalty statement agreement that applies to your tax status. By signing up you accept these terms and the licence agreement.
2. Who may use unblurz and your account
- You must be over 18 and have legal capacity to enter into contracts.
- You sign up with a mobile number that we verify by SMS. Each mobile number may only have one account, and each person may only have one account.
- The information you give us (username, birth date, email, tax and bank details) must be true and up to date. If we detect false information, we may suspend the account.
- You are responsible for what is done from your account. Keep your device and your mobile number under your control and tell us through the Contact page if you suspect unauthorised use.
- To collect royalties or publish content that moderation marks as sensitive you will need to complete identity verification level 1 (identity document and liveness check with our provider Didit, complete tax profile and a bank account in your name).
3. Content rules
You may only upload content you own or for which you hold all the necessary rights, and in which every person who appears has given their consent. The following is prohibited:
3.1 Sexual content or nudity
Explicit sexual content, nudity or sexual activity. Adult content is not allowed on unblurz at this stage of the service, even if it is legal and the people who appear are adults.
3.2 Third-party content
Content protected by copyright, trade marks or other intellectual or industrial property rights of third parties for which you do not hold the rights needed to license it to unblurz (for example, films, series, music, courses, books or other people's photographs).
3.3 Minors
Any content in which minors appear in a sexualised or sensitive context. Tolerance is zero: on any suspicion we block the content, suspend the account, preserve the evidence and report it to the authorities.
3.4 Content without consent
Content showing people who have not consented to its distribution, and in particular intimate images or videos shared without consent, hidden recordings or manipulated content (including AI-generated content) depicting real people without their permission.
3.5 Graphic violence
Content showing explicit real violence, serious injuries, cruelty to people or animals, or that glorifies or incites violence.
3.6 Hate
Content that promotes hatred, discrimination, hostility or violence against people or groups because of their origin, ethnicity, religion, sex, sexual orientation, gender identity, disability or any other protected characteristic, including symbols of hate organisations.
3.7 Fraud and scams
Content that does not match what is advertised, misleading descriptions, scams, investment or "easy money" schemes, impersonation or any use of unblurz to deceive buyers.
3.8 Malware and executables
Malicious software, viruses, executable files or installers, and any file designed to damage devices or access them without permission. Some executable file types are rejected automatically on upload.
3.9 Other illegal content
Any other content that is illegal under Spanish or European Union law, or that facilitates illegal activities (for example, selling third parties' personal data, forged documents, weapons or drugs).
3.10 Other breaches of these terms
Any other use contrary to these terms, such as creating several accounts, circumventing a suspension, manipulating moderation, using unblurz to buy your own content or that of linked accounts, or interfering with the operation of the service.
4. How the sale works (resale model)
- When you upload a file and set its price, you grant us a non-exclusive licence over it under the Content licence and royalties agreement.
- unblurz is the seller of the content: it sells in its own name to the buyer, charges the price, issues the invoice and handles customer support and refunds.
- In return, we owe you a royalty for each confirmed sale. Your royalties are a contractual credit against unblurz: they are recorded as accrued royalties, become payable royalties after the holding period and are paid through a settlement to your bank account. Amounts and periods are set out in the licence agreement and shown in the app.
- unblurz is not a payment institution and does not hold money on behalf of third parties: what the buyer pays is revenue of unblurz.
5. Automated moderation
- Before a link is published, we automatically analyse every image, every video and the first pages of every PDF with content detection systems.
- Depending on the result:
- if the content is suitable, the link is published automatically;
- if it is sensitive, the link is held until you complete identity verification level 1 and a person from our team reviews it;
- if it is prohibited, the link is blocked and not published.
- We keep a fingerprint (hash) of every blocked file: that same file cannot be uploaded again.
- Audio files and other file types are not analysed automatically: their moderation depends on reports and on our team's reviews.
- Automated systems can make mistakes. If you think a decision is wrong, you can appeal it (section 9).
6. Reports (notice and action)
- Anyone can report a link or a profile from the web, without an account, giving the reason, the details and, optionally, an email address to receive the answer.
- Reports about minors or content without consent hide the link immediately, so that it cannot be bought until our team reviews it.
- Other reports are reviewed with a target time of 48 hours.
- If the reporter left an email address, we tell them our decision.
7. Measures we may take
- After a review we may: approve the content, block the link, require identity verification, suspend the account or close it permanently.
- While an account is suspended, its links are hidden and no settlements are made. Buyers keep access to what they bought, unless the content is illegal.
- If we block content because it is illegal, we revoke the buyers' access, refund the amount they paid, and the royalties for that content are withheld or reversed through the corresponding correcting entries, under the licence agreement.
- We apply measures in proportion to the seriousness, repetition and intent of the breach.
8. Statement of reasons
When we block a link, restrict the visibility of your content, suspend or close your account or withhold royalties, we will send you a statement of reasons (Article 17 of the Digital Services Act, DSA) stating:
- the measure taken and its scope;
- the rule of these terms applied (for example, "3.5 Graphic violence") or, where applicable, the legal provision;
- the facts and circumstances relied on, including whether we acted on a report;
- whether automated means were used to detect the content or to take the decision;
- how to appeal the decision.
We will not send the statement of reasons when informing you could hinder the investigation of a serious crime (for example, suspected child sexual abuse) or when an authority orders us not to.
9. Internal complaint-handling system
- You can appeal any of the decisions in section 8 from the app within 6 months of our notifying you (Article 20 DSA).
- You can appeal once per decision, explaining why you think it is wrong and providing any information you consider useful.
- The appeal is reviewed by a different person from our team than the one who took the decision, not solely by automated means.
- We will answer with reasons and without undue delay. If we agree with you, we will reverse the measure.
- You may also go to a certified out-of-court dispute settlement body (Article 21 DSA) and, in any case, to the courts. [PENDING LAWYER: list the certified bodies available in Spain on the publication date.]
- If your account is suspended, you can sign in to the app to read the reason and file the appeal.
10. Reporting to the authorities
- If we become aware of information giving rise to a suspicion of a crime threatening the life or safety of people, we report it to the authorities (Article 18 DSA).
- Any suspicion of child sexual abuse material is always reported to the Spanish National Police (Policía Nacional) or the Guardia Civil.
- In those cases we preserve the evidence (including the file, in an isolated location) for as long as the investigation requires.
11. Single point of contact
Authorities and users can contact us on matters relating to the Digital Services Act (Articles 11 and 12 DSA) through the point of contact published on the Contact page (unblurz.me/contact). Languages of communication: Spanish and English.
12. Tax responsibility
- Your tax situation is your responsibility. You must declare the income you obtain from your royalties according to your tax status and your country.
- If you sell on a regular basis, you may have to register as self-employed or as a professional. The app will alert you when your sales exceed a volume that may indicate regular activity, but that alert is not tax advice. If your tax status changes, update your tax profile in the app.
- We apply the withholdings and payments on account required by law based on the tax details you give us.
13. Account deletion
- You can delete your account at any time from the app.
- When you delete it, we anonymise your personal data, hide your links and close your sessions. Buyers keep access to what they have already bought.
- As required by law, we keep orders, invoices, self-bills, royalty statements and the royalty ledger for 6 years.
- If you have pending payable royalties, we will settle them in the next settlement cycle provided your tax profile is complete and your identity is verified.
- We may also close your account for a serious breach of these terms, in accordance with sections 7 to 9.
14. Liability
- You are responsible for the content you upload and for any damage it causes to third parties or to unblurz through a breach of these terms, under the licence agreement.

15. Changes to these terms
We may change these terms. We will notify you in the app with reasonable notice and, if the change is material, we will ask you to accept the new version to keep using the service. Each version is dated and recorded.
16. Governing law and jurisdiction
